By accessing TrueHeroFund.org, you are agreeing in good faith to the following terms. If you do not wish to be bound by these terms and conditions, you may not access or use TrueHeroFund.org. If you breach any of the terms of this Policy, your authorization to use TrueHeroFund.org automatically terminates.

TRUE HERO FOUNDATION’s Proprietary Rights and Re-Use Policy

The materials on TrueHeroFund.org are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the materials may violate such laws. You agree to comply with all applicable laws, governmental regulation and guidelines with respect to or otherwise arising out of your use of TrueHeroFund.org.

TrueHeroFund.org provides links to other websites and resources. Because TRUE HERO FOUNDATION has no control over these sites and resources, you acknowledge and agree that TRUE HERO FOUNDATION does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

Claims of Copyright Infringement

The Digital Millennium Copyright Act of 1998 provides recourse for copyright owners who believe that material appearing on the Internet infringes on their rights under U.S. copyright law. If you believe in good faith that materials hosted by TRUE HERO FOUNDATION infringe your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. Notices and counter-notices must meet the then-current statutory requirement.

Disclaimers

TrueHeroFund.org and its materials are provided “AS-IS.” TRUE HERO FOUNDATION does not make any express or implied warranties, representations, or endorsements whatsoever with regard to the materials or related information.

TrueHeroFund.org may include inadvertent inaccuracies or errors. Additionally, the possibility exists that a third party could make unauthorized alterations to TrueHeroFund.org content or features. Although we attempt to ensure the integrity of TrueHeroFund.org, we make no guarantees as to its completeness or correctness. In the event that a situation arises in which TrueHeroFund.org’s completeness or correctness is in question, please contact us with, if possible, a description of the material to be checked and the location (URL) where such material can be found on TrueHeroFund.org, as well as information sufficient to enable us to contact you.

Limitation of Liability

Neither TRUE HERO FOUNDATION nor any of its affiliates, directors, officers, employees or consultants are responsible or liable for any damages of any kind arising out of or relating in any way to TrueHeroFund.org and/or materials contained on TrueHeroFund.org, any linked site or any content or service available through TrueHeroFund.org. Your sole remedy for dissatisfaction with the site, content services, or any linked site is to stop your use of it.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TRUE HERO FOUNDATION and our directors, officers, employees, and consultants, from and against any claim or demand (including reasonable attorney fees) arising from: (a) your activities in connection with TrueHeroFund.org; (b) any violation of this Policy by you; and, (c) any allegation that any submissions or other materials you submit to us or transmit to TrueHeroFund.org infringe or otherwise violate the copyright, trademark trade secret, or other intellectual property or other rights of any third party.

Submissions of Content and TRUE HERO FOUNDATION’s Take-Down Policy

Submissions of content, materials, and postings must be consistent with the following policy; violation of this policy may cause removal of the content by TRUE HERO FOUNDATION. By posting content, you agree to the following terms and conditions.

  • Submissions may not contain material that violates or infringes any person or entity’s rights, including, but not limited to any copyright or the rights of privacy and publicity as those rights are defined under applicable law.
  • Material submitted may not defame any individual or entity.
  • Submissions may not include the posting of materials protected by copyright law, regardless of whether the work has been registered or not, without the express written permission from the holder of those rights.
  • Submissions may not contain the brand names, trademarks, trade dress, logos, seals, or other representations that may be associated with a specific organization or individual, without the express written permission of the party or parties having rights and titles to such materials.
  • Submissions may not contain images, photos, or works of art that are not owned entirely by the submitting party.
  • No images of children will be posted unless appropriate licenses have been obtained from the children’s parents or other guardians.
  • Submissions may not contain information, content, statements, or representations that are inflammatory, dangerous, inappropriate, indecent, obscene, tortious, injurious, defamatory, or libelous. Submissions may not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, sexual identity, or age.
  • Submissions may not contain material that is unlawful.
  • Submissions may not be intended to promote or otherwise facilitate any commercial activity.

TRUE HERO FOUNDATION reserves the right to remove any additional content, including links, in whole or in part for violations of this policy or because the content has been deemed unrelated to the postings or discussion taking place.

If you observe any content or material on TrueHeroFund.org that appears to conflict with any of the above requirements, please contact us. Postings may be removed and reviewed at TRUE HERO FOUNDATION’s discretion, and only in the event that such contents are found to be consistent with the Policy will such content be reposted.

General and Changes

If for any reason a court of competent jurisdiction finds any provision of this Policy, or portion of this Policy, to be unenforceable, that provision will be enforced to the maximum extent permissible so as to affect the intent of this Policy, and the remainder of this Policy will continue in full force and effect. Any failure of TRUE HERO FOUNDATION to enforce or exercise any provision of this Policy or related right will not constitute a waiver of that right or provision.

True Hero Fund Eligibility

In order to be eligible for the True Hero Fund Awards Program (the “Awards Program”), nominees must be at least eighteen (18) years of age or older as of April 16, 2020 and nominees cannot have previously been selected as a True Hero Foundation Hero Finalist or Winner (“Eligible Nominees”). True Hero Fund Heroes may be nominated as set forth herein or chosen by True Hero Foundation. People submitting nominations (“Nominator(s)”) must be at least eighteen (18) years of age as of April16, 2020. True Hero Foundation may determine in its sole discretion at any time to shut down and discontinue the Awards Program for any reason.  At any time, at True Hero Foundation’s discretion, a Nominee may be deemed ineligible for nomination or participation in the Awards Program, be deemed ineligible to receive a monetary grant under the Awards Program or have the monetary grant otherwise due such person as part of the Awards Program (if any) donated to a charitable organization selected by True Hero Foundation in its sole discretion.  Employees and immediate family members of The True Hero Foundation as well as advertising and promotional agencies directly involved in the Awards Program (the “Awards Program Entities”) are not eligible to participate in the Awards Program. The True Hero Foundation and the sponsors of the Awards Program shall herein be collectively referred to as the “Sponsors”.

Nominations

To submit your nomination for the Awards Program log on to www.trueherofund.org and fill out the submission form providing all required contact information for you and your nominee. Nominations MUST be submitted online and must include a video submission describing why you are nominating a particular individual . Mail-in nominations will not be accepted. Nominations must be submitted on behalf of another person. Self-nominations will not be accepted.  Nominations must be submitted in English only. Nominations may only be submitted in the name of a single person; group nominations are not acceptable. False or deceptive nominations or acts may render a nominee ineligible. All nominations become the property of True Hero Foundation and will not be returned. True Hero Foundation reserves the right to edit the nomination as it sees fit for use in publication or promotion. By submitting a nomination you agree to grant Sponsors the right without obligation, unless prohibited by law, to use the contents of your nomination, your video, your name, voice, picture and likeness, without compensation, for the purpose of advertising and publicizing all matters related to the Awards Program and/or the Sponsors in any medium, throughout the world in perpetuity.

Privacy

Nominees may be contacted to provide additional information and have their information verified. True Hero Foundation reserves the right to request and require additional information from nominees in order to have their nomination considered.

For our international users, please be aware that the information you submit when registering for our services is collected in the United States of America. In addition to being subject to our privacy policy located at trueherofund.org/privacy, the collection, storage, and use of your data will be subject to U.S. laws and regulations, which may be different from the laws and regulations of your home country. By registering for this program, you are consenting to this collection, storage, and use.

Notification and Publication

Some nominees may be notified by phone, email, or postal service and may be required to submit additional information. At the sole discretion of True Hero Foundation, Finalists may be asked to attend an awards ceremony (“Awards Ceremony”). If asked to attend the Awards Ceremony, Finalists will be responsible for obtaining all proper documentation (e.g., Visa, Passport) prior to travel. Whether or not compensation will be provided for any portion of such travel will be in True Hero Foundation’s sole discretion. A Finalist may be disqualified at True Hero Foundation’s discretion if he/she chooses not to or is unable to attend the Awards Ceremony.

Finalists and any Hero to be featured online or on-air may be required to sign an affidavit verifying their eligibility in this Awards Program including, but not limited to, liability releases, tax acknowledgment forms and, except where prohibited by law, use of name and likeness releases (“Release Documents”) and return such documents within seven (7) days of issuance of notification. Execution of the Release Documents will grant Sponsors the right, unless prohibited by law, to use the individuals’ names, voices, likenesses, and any of the material provided by them or about them without compensation, for the purpose of advertising and publicizing the services of the Sponsors, all matters related to the Awards Program and the Awards Ceremony in any medium, throughout the world in perpetuity. Notification and/or the featuring of a Hero in no way conveys that a particular Hero has or will be selected as a Winner. If at any point a Hero becomes ineligible, chooses not to participate in the Awards Program or is disqualified for any reason, True Hero Foundation reserves the right to select an alternate Hero.

Taxes

Finalists and Winner are responsible for the reporting and payment of all taxes as well as any other costs and expenses associated with acceptance and use of an award not specified herein as being awarded. A Finalist or Winner who is a United States citizen or resident must properly complete Internal Revenue Service (IRS) Form W-9 and provide to True Hero Foundation prior to receiving an award. Payment to a Finalist or Winner who is not a US citizen or resident may be subject to a US withholding tax, which may be as much as 30% of the award. Additional documents may also be required prior to the provision of any award, including but not limited to IRS Form W-8BEN in the case of any Finalist or Winner who is not a US citizen or resident. Please consult your tax advisor regarding the taxation of your award since special rules may apply.

General

If, for any reason, the Awards Program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Awards Program, True Hero Foundation reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Awards Program. Sponsors assume no responsibility for any error, omissions, interruption, deletion, defect or delay in operation with transmission, communications, line failure, theft or destruction or unauthorized access to or allegation of submissions. Sponsors are not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers, equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, phone lines, or any combination thereof, including any injury or damage to a participant’s computer related to or resulting from participation in this Contest. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE AWARDS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsors are not responsible for any late, lost, garbled, misdirected, incomplete, or damaged entries; any disruptions, injuries, losses or damages caused by events beyond the control of Sponsors; or any printing or typographical errors in any materials associated with the Awards Program. The Awards Program Entities are not in any way responsible or liable for the use of the funds donated or for any damage, loss or injury (including death) resulting from participation in the Awards Program and/or acceptance and use of any awards won.
